Terms of Use
These terms govern your use of the Dead Air streaming app, linear channel, and website (together, the "Service"), operated by Harbinger Security Consulting, LLC ("Dead Air," "we," "us"). By using the Service you agree to these terms. If you do not agree, do not use the Service.
1. The Service
Dead Air is a free, advertising-supported video service offering films, series, and short-form content. No account or payment is required. We may add, remove, or change content, features, and availability at any time without notice.
2. Age and content advisories
The Service carries horror, thriller, and action content that may include violence, disturbing themes, strong language, and other material intended for mature audiences. Titles carry ratings and advisories where available. The Service is not intended for children under 13, and viewers under 18 should use it only with the consent of a parent or guardian.
3. Personal, non-commercial use
You may stream content through the Service for your personal, non-commercial viewing. You may not download, copy, record, redistribute, publicly perform, or otherwise exploit any content, except as expressly permitted by the Service's features. You may not interfere with the Service, circumvent any content protection or advertising, or use automated tools to access it.
4. Advertising
The Service is supported by advertising delivered by platform advertising systems. Advertisements are not endorsements by Dead Air. See our Privacy Policy for how advertising works and your choices.
5. Intellectual property
All content on the Service is owned by Dead Air or licensed from third-party rights holders and is protected by copyright and other laws. The Dead Air name, logos, the Projectionist, Reely, and related characters, artwork, and audiovisual works are the property of Harbinger Security Consulting, LLC and may not be used without written permission. Licensed films remain the property of their respective owners.
6. Submissions and feedback
Film submissions to the Dead Air Horror Festival are governed by the festival rules and license terms published on the submission page. Unsolicited ideas, pitches, or materials sent to us by other means are not accepted in confidence, and we are free to use similar ideas without obligation.
7. Copyright complaints
If you believe content on the Service infringes your copyright, send a notice containing the information required by 17 U.S.C. § 512(c) to our designated agent, Anthony D’Onofrio, Harbinger Security Consulting, LLC, at anthonymdonofrio@gmail.com. We may remove content pending resolution of a credible claim.
8. Disclaimers
The Service is provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all warranties, express or implied, including fitness for a particular purpose and uninterrupted or error-free operation. Content is fiction unless clearly stated otherwise.
9. Limitation of liability
To the fullest extent permitted by law, Dead Air and its owners, officers, and licensors will not be liable for any indirect, incidental, consequential, or punitive damages arising from your use of the Service, and our total liability for any claim will not exceed fifty US dollars ($50). Some jurisdictions do not allow these limitations, in which case they apply to the extent permitted.
10. Termination
We may suspend or restrict access to the Service, in whole or in part, at any time for any reason, including violation of these terms.
11. Governing law and disputes
These terms are governed by the laws of the Commonwealth of Massachusetts, USA, without regard to conflict-of-law rules. Any dispute will be brought in the state or federal courts located in Massachusetts, and you consent to their jurisdiction.
12. Changes
We may update these terms by posting a revised version with a new effective date. Continued use of the Service after a change means you accept the revised terms.
